Qivive successfully represents German company before the Toulouse Court of Appeal

Qivive successfully represented a leading international German furniture manufacturer in labour law appeal proceedings before the Cour d'Appel Toulouse.
The case was of particular significance as it concerned the cross-border application of German and French labour law to a senior sales representative working in France and / as well as the impact of short limitation periods on employee protection rights.
On 4 July 2025, the 4th Chamber of the Cour d'Appel Toulouse upheld the decision of the Conseil de Prud'hommes from February 2023:
The comprehensive claims brought by a former sales representative against the company were dismissed as inadmissible. The court ruled that the application of German law, as agreed in the employment contract, was lawful and that the claimant failed to comply with the relevant limitation period under German law. The first-instance decision was thus confirmed in its entirety and all of the claimant’s claims were dismissed.
